The Surface Rights Board is a quasi-judicial tribunal that grants right of entry and assists landowners/occupants and operators resolve disputes about compensation when operators require access to private land or occupied crown land to develop subsurface resources such as oil, gas, and coal or to build and operate pipelines and power transmission lines.

Mediation Services for the Board

Right of Entry:

If an operator is unsuccessful in negotiating with the landowner in order to gain access to the land, the operator may apply to the Board for a Right of Entry Order. View More >>

Compensation Review:

All parties to a Right of Entry Order or a Surface Lease that provide for the payment of compensation on an annual or periodic basis, or that do not provide for the payment of compensation annual or periodic basis but relate to a major power transmission line as defined in the regulations. View More >>


The Surface Rights Board has the authority to assist landowners/occupants and operators resolve disputes for damage caused by an operator outside the area it has been granted, or for damage to livestock or personal property caused by the operator. View More >>

Recovery of Rentals:

If a person is entitled to rental payments under a Compensation Order, Right of Entry Order, or Surface Lease and that amount remains outstanding, they may apply to the Board. Should payment not be forthcoming, the Board may direct the Minister to pay the amount owing out of the General Revenue Fund. View More >>

Request for Reconsideration:

Requests for reconsideration of Board Orders or Decisions may be granted pursuant to section 29 of the Surface Rights Act. The request will not necessarily lead to a reconsideration of the Order or Decision. View More >>
