The Surface Rights Board is a quasi-judicial tribunal that grants right of entry and assists landowners/occupants and operators resolve disputes about compensation when operators require access to private land or occupied crown land to develop subsurface resources such as oil, gas, and coal or to build and operate pipelines and power transmission lines.

Please note, only a minority of disputes between landowners and operators result in Board decisions; most are resolved by the parties. This means that you might not be able to find any Board decisions about lands near you or that discuss your exact situation.

The Board maintains a list of Board decisions  rouped by application type. For some cases, Board administration has written case summaries (these summaries are unofficial). The Board also maintains a list of Court cases that reviewed Board decisions.

 If you would like to find Board decisions by name, date, location, or keyword, we recommend that you use the search feature on CanLII’s database of Surface Rights Board decisions . On CanLII, you can search by keywords, like:

 You can also search by land description; for example, searching for “52-24-W4” (without leading zeros) will give decisions within township 52, range 24 west of the 4th. Not all townships have Board decisions, so you may need to search several land descriptions around your land to find one.

 Some private surface lease agreements are available in the registry kept by the Alberta Energy Regulator. Be aware, however, that the registry only has agreements that were voluntarily provided to the registry, and it costs money to request copies.
